These conditions below relate specifically to International Domain Registration. If you are registering an New Zealand Domain Address (eg .nz), please click here.

Please read this agreement below in its entirety. All users of our service will be bound by this entire agreement. These terms and conditions may be modified at any time and without notice. All users, both previous and new are always subject to the newest terms posted here at all times.

BACKGROUND
(i) Design Lounge Ltd is the registered company name for Website Hosting and Domain Registration and Web Design services, under the trading name 'Lounge Network'.
(ii) Lounge Network is a .com provider using the services of authorised registrars, GoDaddy & SRSplus, for International domain registrations, who are accredited registrars with ICANN. Lounge Network offer Domain Name registration services to the public, and will personally manage the domain name on your behalf.
(iii) The Registrant has requested Lounge Network to provide domain registration and domain management services to him/her/it, and Lounge Network has agreed to do so on the terms and conditions set out in this Agreement.
(iv) Domain Name Registration will be completed once confirmation of payment is received. Any payment made to us MUST include the 'Domain Name' (eg. yourdomain.co.nz) being registered/renewed, and the 'DAG reference number', with the payment, before we are able to assign and process the domain registration/renewal. With any payment that you make, please email us though our contact page, with the following information (a) The 'Reference' used with the deposit. (This should be your domain name and DAG reference number), (b) The 'Date of Deposit' (xx/xx/xx - the date your made the deposit into our bank account), (c) The 'Amount Deposited' ($xxxx.xx - the amount you deposited), & (d) The 'Bank' the amount was deposited from. Please Note that we need this information, so that we can match your payment with your account, allowing us to process it. If you don’t let us know about the deposit you have made, and we can’t match payment with your account, the amount will not be able to be assigned to your domain until you inform us. This may result in domain cancellation which can result in you permanently losing your domain name. If the payment is for a new domain name, it may result in someone else registering your domain name. Should your domain be cancelled due to an unrecognisable payment, if the domain is still available to be renewed it may result in an uncancellation fee being required, before the domain can be uncancelled and renewed.
(v) Payments for domain registration and renewals can only be accepted where made by Credit Card, Direct Credit, Cheque, or Cash. Should the customer ever issue a chargeback/reversal with their credit card company, for a domain registration/renewal payment that the customer previously made to us, we reserve the right to retrieve the credit card chargeback/reversal costs and the domain registration/renewal fee from the customer, plus any associated costs in the collection of this from the customer.
(vi) Domain names can take anywhere between 24-72 hours to fully migrate over to the Lounge Network servers.
(vii) It is up to you the customer, as the 'registrant' of the Domain Name, to keep a record of when your annual domain registration is due, and pay it before it expires. Lounge Network will endeavor to send you out a reminder, in the form of an email when your domain name is up for renewal, however this is not a binding commitment. You can check the status of your domain name at any time by clicking here, and entering your domain in the domain search box, or by logging into our Domain Manager by clicking here.
(viii) This Domain Name Registration service is only available to people or organisation's residing in New Zealand.
(ix) If there is any change to your domain names contact details, including your email address, you are required to modify your contact details in our Domain Manager by clicking here. If your email address changes and you don't update it in the Domain Manager, it will not be able to send you out email reminders of when your domain is due to expire. Make sure you keep your domain contact details up to date by clicking here. If you would like us to modify these for you manually, we charge a $22.95 + GST administration fee for manually modifying your details with the registrar.
(x) ICANN regulations prohibit transferring a domain name that has been registered or previously transferred within the last 60 days. The registrar will also not allow transfers of domains that are within 10 days of expiration, or that have already expired. If your name is within 30 days of expiration, or has already expired, we recommend that you first renew your domain before you attempt to transfer it, as the transfer process can take a number of weeks. Outside these periods, the domain is able to be transferred to another registrar.
(xi) If there is any change to your domain names contact details, including your email address, you are required to modify your contact details in our Domain Manager by clicking here.
(xii) You acknowledge that it is your responsibility to keep your own records and to maintain your own reminders regarding when your domain registration is set to expire. As a convenience to you, and not as a binding commitment, we may notify you via an email message at the email address we have on record, when renewal fees are due to help avoid expiration. This will be in the form of an invoice or email reminder notice. Should these fees go unpaid, or we don't receive your payment, your domain name will expire or be cancelled. You can check the status of your domain name at any time by clicking here, and entering your domain in the domain search box, or by logging into our Domain Manager by clicking here. Payments details can be found by clicking here.
(xiii) Should a domain expire due to non-payment or some other reason, we may or may not be able to renew it. If we can renew it, we may require to renew it for an additional year on top of its current year (eg. your domain will be renewed for two years instead of one). Additional reconnection fees may also apply for expired domain names.
(xiv) When a Global Domain name expires, its status is changed to "Pending Release" which means the Domain is on hold for approximately 28 days until it is released back into the Domain pool for others to register. To reactive a global Domain in the Pending Release state, will incur an uncancellation fee of approximately $US 300 - 500 fee, plus the normal domain renewal fee. We also do not guarantee that we will be able to get a domain name back, should it expire, and you do risk losing it forever should it remain expired for more than 28 days. We recommend that Domain Names are renewed well before the renewal date to avoid interruption of service and/or penalties fees. When a domain is renewed after having previously expired, it will not be able to be transferred to another registrar for approximately 2 months.
(xv) If you are registering a domain name for, or on behalf of someone else (your are acting as an agent), you represent that you have the authority to nonetheless bind that person as a principal to all terms and conditions provided herein, including the Dispute Policy. You also agree that all terms and conditions will be passed onto your client to read and agree to.
(xvi) If you decide in the future to change to another website host, you will also be required to transfer you domain name to a new provider, unless your domain is registered in our Domain Manager Control Panel. To process a domain transfer, you will need to let us know, and then send through a request to your new domain registration company, who will contact us to process the switch. We reserve the right to charge a transfer fee of $22.95 + GST, to cover our time and administrative costs, in processing the transfer from our end. International domain switches can take a few weeks for the registry to process and transfer. The registrar will not allow transfers of domains that are within 10 days of expiration, or that have already expired. If your name is within 10 days of expiration, or has already expired, you will first need to renew your domain name with us. Please note that we don’t change nameserver settings to any server that isn't our own server. This means that in order to modify nameserver settings to another web host, you will be required to transfer your domain to a domain registration company that allows nameserver modification before you can change the nameserver details. For a fee, of $22.95 + GST, we can personally modify the nameserver settings for you, if you need them changing urgently. This fee covers our time in making the modification.
(xvii) As the domain registrant, you agree that you are liable for any fees associated with your domain name.
(xviii) If you require your details modifying on the International Domain Registry and the domain is being personally managed by us, we reserve the right to charge a $22.95 + GST fee to cover our time and administrative costs. This fee does not apply if your domain is registered in our Domain Manager Control Panel and you make the changes yourself inside the control panel. This fee covers our time in personally making the modifications to your details with the registrar.
(xix) Should the customer encounter an issue with the provided services, before contacting us they must follow the troubleshooting process, as set out in the FAQ section of the hosting website, to make sure that the issue isn't at the customers end. For example, the issue could be caused by the customers ISP, their computer, their local network, or the customers firewall. The customer must also check our Network Status Page on our website, at www.loungenetwork.co.nz, to make sure that the issue hasn't already been posted, before contacting us. If the customer needs to contact us to report an issue or with a question, the customers communication to us must be done via email, via the contact form on our hosting website. We do not provide telephone support for our services under any circumstances. From our experience, email is a far more efficient method for communication, and resolving any technical issues. It also allows us time to discuss solutions to questions with other members before we reply to you. Due to this, we are able to pass the cost savings on to our clients with affordably priced hosting plans and domain registration. Therefore please also don't ask us to telephone you back.
(xx) Tax invoices are generated automatically by the Domain Manager, when the domain is renewed. Invoices can be printed off from inside the Domain Manager at http://www.domains.loungenetwork.co.nz/, by logging into your Domain Manager account, and then clicking in the 'invoices' text link on the top menu. The name and address that will appear in the invoice, will be the admin/billing contact for the domain name that appears in the public whois record for the domain, so please make sure that you keep these details up to date. The billing details on the invoice cannot be changed, once the domain is renewed and generated by the system. Invoices are not emailed or mailed, and are only able to be retrieved through the domain manager system. We charge $5 if you would like us to mail you your invoice (within NZ only). If you would like us to mail you an invoice, please add $5 onto the domain registration/renewal price, and email us to let us know.
(xxi) The domain registration/renewal fee does not cover any other services, such as website hosting, domain/email direction, web design and programming fees etc.
(xxii) We are not obligated to provide any form of domain management system with your domain name. We do however provide a domain management system to some of our domain registration clients as a courtesy, and we reserve the right to restrict access to it at anytime, and without notice. Clients who do not have access to a domain management system will need to contact us to make any changes, and additional fees may apply depending on the changes required.
(xxiii) As a domain registrant, you are also bound by all of the conditions below.
(xxiv) If you are also signing up to a web hosting account, at the same time as registering a domain, the account owner and contact details of the web hosting account will also be applied to the domain registration.
(xxv) Although we do our best to ensure that the prices stated on our websites are accurate, errors may occur from time to time. Sometime pricing errors are due to issues with our upstream providers own systems. Where a pricing error occurs, we will not be bound by the incorrect pricing stated, and reserve the right to cancel your order.
(xxvi) With domain renewal payments, if you have more than one domain name, and the domain to be renewed isn't referenced with your payment, then the domain with the least registration period remaining, will be the domain that is renewed.
(xxvii) All users and registrants are also bound by the Registrars and the International Terms and Conditions below:

International Domain Agreement (PDF)

1. Payment of Fees

1.1 You agree to pay for the services we provide for you.
1.2 If you transfer a domain name registered to you to another registrant or to be managed by another registrar, all charges owing to us shall become immediately due and payable on the date of that transfer.
1.3 We may alter our fees at any time without notice.
1.4 Our usual fees are for domain name registration and renewal. We may also charge for any other services provided to you by us, including any programming or configuration requirements outside of the scope of standard registration, change of name holder etc. We will tell you before any additional charge is incurred.
1.5 We reserve the right to charge specific clients, who only source domain registration services from us, an Annual Domain Name Administration Fee on top of the normal domain registration fee. This additional fee DOES NOT apply for those clients who we also supply other services to, eg Website Hosting and /or Email services. This Annual Domain Name Administration Fee will be $53.33 + GST per year, and will usually be payable at the time of domain registration or renewal, and will provide users with free forwarding options. This Annual Domain Name Administration Fee will be invoiced separately from Domain Registration/Renewal and web site hosting.
1.6 Our prices are stated in New Zealand dollars and exclude GST.
1.7 If you do not pay our charges for a domain name that we register or renew for you, we may refer any such amounts owed by you to a debt collection agency and you shall be responsible for payment of all charges that may be incurred in the recovery of such unpaid amounts; or cancel your domain, providing you with 14 days prior notice to cancellation.
1.8 Interest may be charged on any amount owing after the Due Date at the rate of 5% per month or part month. Interest will accrue from the Due Date to date of actual payment. Interest on unpaid accounts is compounded monthly. In the case of accounts that are more than two months overdue, an administration fee of $22.95 + GST may be charged.
1.9 All fees are non-refundable, in whole or in part, even if your domain name registration is suspended, cancelled or transferred prior to the end of your then current registration term.
1.10 Your domain name application, renewal application, or registrar transfer request will not be submitted to the registry unless we receive actual payment of the registration, renewal, or transfer fee, or reasonable assurance of payment of the registration, renewal, or transfer fee from some other entity (such reasonable assurance as determined by Lounge Network in its sole discretion). In any case, we may in our sole discretion register or renew a domain name for a period less than that for which you may have applied pending receipt of cleared funds from you for such services. Subsequent to the receipt of cleared funds we will amend the register so that the registration or renewal is for the full term.

All domain registrants are also bound by the following conditions of our provider below.

This Go Daddy Software, Inc. Domain Name Registration Agreement ("Agreement") is by and between Go Daddy Software, Inc. ("Go Daddy") an Arizona Corporation and You, Your heirs, agents, successors and assigns ("You"), and is made effective as of the date of electronic execution. This Agreement sets forth the terms and conditions of Your use of Go Daddy's Domain Name Registration and represents the entire agreement between You and Go Daddy. By participating in this transaction, You acknowledge that You have read, understand and agree to be bound by all the terms and conditions of this Agreement, including our dispute policy, along with any new, different or additional terms, conditions or policies which Go Daddy may establish from time to time. You may view the latest version of this Agreement online.

In addition to transactions entered into by You on Your behalf, You also agree to be bound by the terms of this agreement for transactions entered into on Your behalf by anyone acting as Your Agent, and transactions entered into by anyone who uses the account You've established with Go Daddy, whether or not the transactions were in Your behalf. You acknowledge that Go Daddy's acceptance of any application made by You for services provided by Go Daddy will take place at Go Daddy's offices located in Scottsdale, Arizona, USA.

You acknowledge that Go Daddy is a registrar bound by an agreement between Go Daddy and the Internet Corporation for Assigned Names and Numbers ("ICANN"). You agree that Go Daddy may modify this agreement in order to comply with applicable law and the terms and conditions set forth by the Internet ICANN and/or the Registry Administrator chosen by ICANN, as well as any registration rules or policies that may be published from time to time by Go Daddy.

1. fees

In consideration for the services and products ("service") purchased by You and provided to You by Go Daddy, You agree to pay Go Daddy at the time service is provided. Payment is to be made by You by providing either a valid credit card, an online check, or using "Good as Gold" to establish a cash reserve for charge by Go Daddy (collectively, the "Payment Method"). Personal checks and money orders may only be used only to fund "Good As Gold" (GAG) accounts, must be for payments of $100 or more, and issued in U.S. dollars for the full amount required at that time. Personal checks under $1,000 are subject to the same processing fees as wire transfers. All personal checks will be delayed fourteen (14) days until the money is credited, which may delay Your usage of the product or service, and any check that bounces will result in a $25 bounced check fee. If You purchase an automatically renewing service or product by personal check, it is Your responsibility to make payment arrangements for each renewal payment. Payments are non-refundable. If for any reason Go Daddy is unable to charge Your Payment Method for the full amount owed Go Daddy for the service provided, or if Go Daddy is charged a penalty for any fee it previously charged to your Payment Method, You agree that Go Daddy may pursue all available remedies in order to obtain payment. You agree that among the remedies Go Daddy may pursue in order to effect payment, shall include but will not be limited to, immediate cancellation without notice to You of any domain names registered or renewed on Your behalf. Go Daddy reserves the right to charge a reasonable service fee for administrative tasks outside the scope of its regular services. These include, but are not limited to, customer service issues that cannot be handled over email but require personal service, and disputes that require legal services. These charges will be billed to the Payment Method we have on file for You. You may change your Payment Method at any time by logging into Your Account Manager.

Domain Name Renewals

When You register a domain name, You have the option to elect that the domain name be automatically renewed upon reaching the expiration date. If You elect the automatic renewal option, Go Daddy will automatically renew, for a period equivalent to the length of your original registration, any domain name that is up for renewal and will take payment from the Payment Method You have on file with Go Daddy, at Go Daddy's then current rates. Thus, if you have chosen to register your domain name for one year, Go Daddy will automatically renew it for one year. If you have chosen to register your domain name for two years, Go Daddy will automatically renew it for two years, and so on.  Domain name renewals will be non refundable. If for any reason Go Daddy is not able to take the payment from the Payment Method You have on file, and You fail to respond to our notices, Your domain name registration will expire. It is Your responsibility to keep Your Payment Method information current, which includes the expiration date if you are using a credit card. If You do not elect that the domain name be automatically renewed, You have the responsibility of logging into Your account manager for that domain name and manually implementing the renewal by the expiration date (should You in fact want the domain name to be renewed). In this case, if You fail to manually implement the renewal in a timely fashion the domain name will be cancelled and You will no longer have use of that name. You agree that Go Daddy will not be responsible for cancelled domain names that You fail to renew, either automatically or manually. In any case, if You fail to renew Your domain name in a timely fashion, additional charges may apply. If You signed up for domain masking, domain forwarding, or any other similar service, with Your domain registration, these services may be automatically renewed when Your domain registration is up for renewal, and You may incur an additional renewal fee unless You cancel in advance.

2. term of agreement; modifications

The term of this agreement shall continue in full force and effect as long as You have any domain name registered through Go Daddy. You agree that You will not transfer any domain name registered through Go Daddy to another domain name registrar during the first sixty (60) days from its initial registration date.

You agree that Go Daddy may modify this agreement from time to time. Go Daddy may also discontinue services it provides under this agreement. You agree to be bound by any changes Go Daddy may reasonably make to this agreement when such changes become effective. Should You elect to cancel Your agreement with Go Daddy You will not receive a refund for any fees You may have paid to Go Daddy.

You agree that Go Daddy shall not be bound by any representations made by third parties who You may use to purchase services from Go Daddy, and that any statements of a general nature, which may be posted on Go Daddy's web site or be contained in Go Daddy's promotional materials, will not bind Go Daddy.

3. up to date information; use of information

You agree to notify Go Daddy within five (5) business days when any of the information You provided as part of the application and/or registration process changes. It is Your responsibility to keep this information in a current and accurate status. Failure by You, for whatever reason, to provide Go Daddy with accurate and reliable information on an initial and continual basis, shall be considered to be a material breach of this agreement. Failure by You, for whatever reason, to respond within five (5) business days to any inquiries made by Go Daddy to determine the validity of information provided by You, shall also be considered to be a material breach of this agreement.

You agree that for each domain name registered by You the following information will be made publicly available in the Whois directory as determined by ICANN Policy and may be sold in bulk as set forth in the ICANN agreement:

  • The domain name
  • Your name and postal address
  • The email address, postal address, voice and fax numbers for technical and administrative contacts
  • The Internet protocol numbers for the primary and secondary name servers<//li>
  • The corresponding names of the name servers
  • The original date of registration and expiration date

You agree that, to the extent permitted by ICANN, Go Daddy may make use of the publicly available information You provided during the registration process. If You engage in the reselling of domain names You agree to provide any individuals whose personal information You've obtained, information about the possible uses of their personal information pursuant to ICANN policy. You also agree to obtain consent, and evidence of consent, from those individuals for such use of the personal information they provide.

4. dispute resolution policy

You agree to be bound by our current Dispute Resolution Policy. This policy is incorporated herein and made a part of this agreement. You can view the Uniform Domain Name Dispute Resolution Policy online. You agree that Go Daddy may from time to time modify its Dispute Resolution Policy. Go Daddy will post any changes to its Dispute Resolution Policy at least 30 days before they become effective. You agree that by maintaining Your domain name registrations with Go Daddy after the updated policy becomes effective that You agree to the Dispute Resolution policy as amended. You agree to review Go Daddy's web site periodically to determine if changes have been made to the Dispute Resolution Policy. If You cancel Your agreement with Go Daddy as a result of the modified Dispute Resolution policy no fees will be refunded to You.

You agree that if a dispute arises as a result of one or more domain names You have registered using Go Daddy, You will indemnify, defend and hold Go Daddy harmless as provided for in this agreement. You also agree that if Go Daddy is notified that a complaint has been filed with a governmental, administrative or judicial body, regarding a domain name registered by You using Go Daddy, that Go Daddy, in its sole discretion, may take whatever action Go Daddy deems necessary regarding further modification, assignment of and/or control of the domain name deemed necessary to comply with the actions or requirements of the governmental, administrative or judicial body until such time as the dispute is settled. In this event You agree to hold Go Daddy harmless for any action taken by Go Daddy.

5. transfer of domain names; resale practices

If You transfer any domain name You agree to provide the information required by, and to abide by, the procedures and conditions set forth in our Domain Transfer Agreement. You may view the latest version of our Domain Transfer Agreement online.

You agree to inform any customer of Yours, who may be acquiring a domain name through You using Go Daddy's registration services, that they are in fact registering their domain name through Go Daddy and that Go Daddy is an accredited registrar with ICANN. You agree not to represent that You are an ICANN accredited registrar or that You are in any way providing superior access to the ICANN Domain Name Registry. You also agree not to use the ICANN trademark logo in any of Your promotional materials including Your web site.

You agree to obtain each of Your customers' acceptances of Go Daddy's then current Domain Registration Agreement, and to retain evidence of their acceptance for a period of not less than three (3) years. Should You require that Your customers accept additional terms and conditions that are not required by Go Daddy, You agree that such additional terms and conditions shall not conflict with Go Daddy's Domain Registration Agreement and the policies and business procedures adopted by ICANN.

You agree that Go Daddy is not lending You access to its registrar connections or its registry access, nor will You be deemed to be a registrar in Your own right. Furthermore, You agree You will not attempt to gain access to Go Daddy's registrar connections or registry access. You agree to provide complete, accurate and current data for each registrant to be added to a registry in accordance with ICANN requirements for inclusion in the Whois database.

You agree to provide Your customers with adequate customer support, and to maintain contact with them with regard to providing a medium for them to communicate changes in the information they provided as part of the domain name registration process. Upon receiving corrected or updated information You will, within 5 business days, provide such information to Go Daddy so Go Daddy may update its registration records. You will retain copies of all communications between You and Your customers and will upon request provide Go Daddy copies of same.

6. suspension of services; breach of agreement

You agree that, in addition to other events set forth in this agreement, Your ability to use any of the services provided by Go Daddy is subject to cancellation or suspension in the event there is an unresolved breach of this agreement and/or suspension or cancellation is required by any policy now in effect or adopted later by ICANN.

You agree that Your failure to comply completely with the terms and conditions of this agreement and any Go Daddy rule or policy may be considered by Go Daddy to be a material breach of this agreement and that Go Daddy may provide You with notice of such breach either in writing or electronically (i.e. email). In the event You do not provide Go Daddy with material evidence that You have not breached Your obligations to Go Daddy within ten (10) business days, Go Daddy may terminate its relationship with You and take any remedial action available to Go Daddy under the applicable laws. Such remedial action may be implemented without notice to You and may include, but is not limited to, canceling the registration of any of Your domain names and discontinuing any services provided by Go Daddy to You. No fees will be refunded to You should Your agreement be cancelled or services be discontinued because of a breach.

Go Daddy's failure to act upon or notify You of any event, which may constitute a breach, shall not relieve You from or excuse You of the fact that You have committed a breach.

7. restriction of services; right of refusal

You agree not to use the services provided by Go Daddy, or to allow or enable others, to use the services provided by Go Daddy for the purposes of:

  • The transmission of unsolicited email (Spam).
  • Repetitive, high volume inquires into any of the services provided by Go Daddy (i.e. domain name availability, etc.).

If You are hosting Your domain's domain name servers ("DNS") on Go Daddy's servers, or are using our systems to forward a domain, URL, or otherwise to a system or site hosted elsewhere, or if You have your domain name registered with Go Daddy, You are responsible for ensuring that there is no excessive overloading on Go Daddy's DNS systems. You may not use Go Daddy's servers and Your domain as a source, intermediary, reply to address, or destination address for mail bombs, Internet packet flooding, packet corruption, or other abusive attack. Server hacking or other perpetration of security breaches is prohibited. You agree that Go Daddy reserves the right to deactivate Your domain name from its DNS system if Go Daddy deems it is the recipient of activities caused by your site that threaten the stability of its network.

You agree that Go Daddy, in its sole discretion and without liability to You, may refuse to accept the registration of any domain name. Go Daddy also may in its sole discretion and without liability to You delete the registration of any domain name during the first thirty (30) days after registration has taken place. Go Daddy may also cancel the registration of a domain name, after thirty (30) days, if that name is being used in association with spam or morally objectionable activities. Morally objectionable activities will include, but not be limited to: activities designed to defame, embarrass, harm, abuse, threaten, slander or harass third parties; activities prohibited by the laws of the United States and/or foreign territories in which You conduct business; activities designed to encourage unlawful behavior by others, such as hate crimes, terrorism and child pornography; activities that are tortious, vulgar, obscene, invasive of the privacy of a third party, racially, ethnically, or otherwise objectionable; activities designed to impersonate the identity of a third party; and activities designed to harm minors in any way. In the event Go Daddy refuses a registration or deletes an existing registration during the first thirty (30) days after registration, You will receive a refund of any fees paid to Go Daddy in connection with the registration either being canceled or refused. In the event Go Daddy deletes the registration of a domain name being used in association with spam or morally objectionable activities, no refund will be issued.

8. limitation of liability

You agree that Go Daddy's entire liability to you under this agreement, and your only remedy, in connection with any service provided by Go Daddy, to you under this agreement, and for any breach of this agreement by Go Daddy, shall be limited to the fees you paid to Go Daddy for the particular service in contention. Go Daddy and its agents and contractors shall not be liable for any direct, indirect incidental, special, or consequential damages resulting from the use of or inability to use any of Go Daddy's services or for the cost of obtaining substitute services. Because certain states do not permit the limitation of elimination of liability for certain types of damage, Go Daddy's liability shall be limited to the smallest amount permitted by law. Go Daddy disclaims any loss or liability resulting from:

  13. application of Go Daddy's Dispute Resolution Policy
  14. any act or omission caused by You or Your agent (whether authorized by You or not)

9. indemnity

You agree to release, defend, indemnify and hold harmless Go Daddy and its contractors, agents, employees, offices, directors, shareholders and affiliates from and against any losses, damages or costs, including reasonable attorney's fees, resulting from any claim, action, proceeding suit or demand arising out of or related to Your (including Your agents, affiliates or anyone using Your account with Go Daddy whether or not on Your behalf, and whether or not with Your permission) use of the services provided by Go Daddy. Should Go Daddy be notified of a pending law suit, or receive notice of the filing of a law suit, Go Daddy may seek a written confirmation from You concerning Your obligation to indemnify Go Daddy. Your failure to provide such a confirmation may be considered a breach of this agreement.

10. representation and warranties

You warrant that all information provided by You as part of the registration process is complete and accurate. You also warrant that each registration You make is being done so in good faith and that You have no knowledge of it infringing upon or conflicting with the legal rights of a third party or a third party's registration, trademark or trade name. You also warrant that the domain name being registered will not be used in connection with any illegal activity.

You agree that Go Daddy makes no representations or warranties or any kind in connection with this agreement and specifically makes no guaranty to You against the possibility of objection to, or challenge of, the registration or use of any domain name You register with Go Daddy.

Go Daddy expressly reserves the right to deny, cancel or transfer any registration that it deems necessary, in its discretion, to protect the integrity and stability of the registry, to comply with any applicable laws, government rules or requirements, requests of law enforcement, in compliance with any dispute resolution process, or to avoid any liability, civil or criminal, on the part of Go Daddy, as well as its affiliates, subsidiaries, officers, directors and employees. Go Daddy also reserves the right to freeze a domain name during resolution of a dispute.

11. disclaimer of warranties

Go Daddy expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Go Daddy does not warrant, nor make any representations regarding the use, or results of, any of the services it provides, in terms of their correctness, accuracy, reliability, or otherwise.

All Customers who registered their International Domain names through us via our Domain Manager website, are also bound by the SRSplus Deletion Policy below:

SRSplus Deletion Policy

Domain names are registered for fixed periods that are subject to renewal. If the Partner does not renew the domain name by the expiration date, the domain name is subject to deletion at any time after that. In an effort to help our customers avoid unintentional deletion of their domain names, we may, but are not obligated to, provide our customers with a “grace period” after their domain name expiration dates. We currently endeavor to provide a grace period of at least 30 days during which a domain name can be renewed; however, a grace period is not guaranteed and can change at any time without notice. Consequently, every Partner who desires to renew his or her domain name registration services should do so in advance of the expiration date to avoid any unintended domain name deletion.

If a domain name is not renewed as outlined above, absent extenuating circumstances, we will delete the domain name. Registry Operators may provide registrars with the ability to “redeem” a deleted domain name for a customer, and we, in turn, may (but are not obligated to) provide customers with an ability to redeem a particular domain name. Such a Redemption Grace Period (RGP) is not guaranteed and customers should renew their domain name services in advance of the domain name expiration dates to avoid deletion of domain names. Currently, the Registry Operators provide an RGP for 30 days from the date of deletion. If we decide to provide the redemption service to a customer, we charge a fee of approximately $USD 300 - 500 ( this is an approximate amount and the actual amount could be more or less than this) to redeem and renew a domain name during the RGP. If the domain name is not renewed by the expiration of the RGP, it is then placed on “Pending Delete” status for five more days, after which it is deleted and the domain name character string is then once again available for registration.

In the event a domain name is the subject of a Uniform Domain Name Dispute Resolution Policy (UDRP) proceeding and expires or is deleted during the course of the dispute, the complaining customer has the option to renew or restore the domain name under the same commercial terms as the original customer. If the case ultimately is terminated or the arbitrator finds against the complaining customer, the name will be deleted within 45 days.
